A sub-standard UNSW General Staff Agreement that undercuts award conditions on job security was approved at a staff ballot with CPSU support. NTEU objected to the approval of the Agreement by Fair Work Australia (FWA) on the grounds that the Agreement fails the “Better Off Overall Test” (BOOT)  and was not made in accordance with the provisions of the Act. Following several hearings, Fair Work Australia finally approved the Agreement. NTEU is appealing this decision which will be heard by a Fair Work Australia Full Bench at the end of March.

Meanwhile, negotiations for an Academic Staff Agreement are continuing.


Similar to UNSW, Macquarie University put a General Staff Agreement to ballot in late September, thereby splitting what had previously been an all-staff Agreement. Despite a strong campaign from the Branch the Agreement was approved with a 57% vote in favour. Again, the Union challenged the approval of the Agreement on a wide range of grounds, but unfortunately the Agreement was approved. NTEU is appealing this decision as well, which will be heard by a Fair Work Australia Full Bench at the start of April.

In the aftermath of the approval of the General Staff Agreement, a further protected action ballot was successfully held to approve the use of bans on transmission of exam results, as part of the on-going campaign to achieve a satisfactory Academic Staff Agreement. Industrial action is planned for the beginning of first semester.


Management's latest draft Agreement put to the NTEU bargaining team is grossly deficient on pay and job security. Under management's proposal, Wollongong academics would become the lowest paid in NSW, and fixed-term employment would continue to sky-rocket. The Branch is organising a comprehensive campaign commencing with a series of members meetings to improve menagement's poor offer.
